2. Definitions
- Seller means the business named in section 1, which runs the Edulo online shop.
- Buyer means the person who places an order in the shop. This may be a consumer or another person, for example a preschool, its founding body or a company.
- Consumer means a natural person who, when concluding and performing the contract, is not acting for purposes of their trade, business or profession. If a teacher buys in their own name and without the billing details of a school or company, we treat them as a consumer.
- Activity means digital content: an interactive game or exercise for preschool children in the form of an HTML file that runs in a web browser.
- Bundle means several activities sold together at a reduced price.
- Licence means the right to use an activity under the licence terms.
3. Subject of the contract and features of the activities
- The subject of the contract is the supply of the activities or bundles listed in the order as digital content (a file to download) and the grant of a licence to use them in the whole preschool under the licence terms. The licence is the same for every buyer.
- The main features of each activity are shown on its page: theme, what it develops in children, approximate length, mode of play, language, file format and size. If an activity has a demo, you can try it before buying.
- Functionality, compatibility and interoperability: an activity is an HTML file. It opens with a double-click in the current version of Google Chrome, Microsoft Edge or Mozilla Firefox on a computer running Windows 10 or 11 or the current version of macOS. It is controlled by touch on an interactive whiteboard, with a mouse or with a touchpad. The internet is needed only for downloading. The activity needs no installation, account or login. We do not guarantee that it works on tablets or mobile phones. See Technical requirements for details.
- Technical protection measures: the activities have no copy protection (DRM), do not collect or send any data and do not need an internet connection. The permitted use is defined by the licence.
- Updates: the activities do not need updates to work. If we fix a bug in an activity, we will send you the corrected file free of charge on request.
- We sell the activities electronically only. We do not supply them on a tangible medium (such as a USB stick or CD).
4. Ordering and conclusion of the contract
No registration is needed. The steps are:
- You add activities or bundles to the cart.
- At checkout you enter your email, first and last name and country. If you are buying for a school or company, you also enter the billing details.
- You confirm your agreement with the terms and conditions and the licence terms and give your express consent to the supply of digital content starting before the end of the withdrawal period (section 8).
- You click Order with obligation to pay. This sends a binding order.
- You pay the price on the secure page of the payment gateway.
Further rules:
- Before sending the order you can check and correct your details at any time. In the cart you can change items, and at checkout you can correct the form. The total price is shown in the order summary, and the checkout highlights missing or incorrect details.
- We confirm receipt of your order on screen right after you send it, together with the order number, and redirect you to the payment.
- The contract is concluded when the price is paid, that is when the payment gateway confirms a successful payment. If you do not complete the payment, no contract is concluded.
- We will send you a confirmation of the contract by email no later than when the activities are made available. It will contain the list of activities, the price, confirmation of your consent to the early supply of digital content and of your declaration, and, as an attachment, these terms and conditions, the licence terms and the information on withdrawal.
- The contract is concluded in the language of the shop version in which you ordered: Slovak, Czech, Polish or English. We archive the order electronically; it is not publicly accessible. We will send you a copy on request.
- Before the contract is concluded, we may refuse an order, in particular if the price of an activity is obviously wrong or the activity is not available. If you have already paid, we will refund you without undue delay.
5. Price and payment
- The prices shown with the activities and in the cart are final. The seller is not registered for VAT, so the prices do not include VAT.
- Prices are in the currency of the shop version: euros (Slovak and English versions), Czech crowns (Czech version) or Polish zloty (Polish version). The price in each currency is set separately, not converted by an exchange rate.
- No other fees are added to the price. Delivery is electronic and free, and there is no payment fee.
- You pay in advance online through the Stripe payment gateway, by card (Visa, Mastercard) or with Apple Pay or Google Pay. You enter your card details only on the payment gateway page; the seller never receives them.
- For a bundle we also show the total price of the activities bought separately and your saving. A bundle contains the activities that are in it on the day of purchase. Activities added to the shop later are not included.
- The email confirming the contract also confirms payment of the price. We will email you an invoice. For a purchase for a school or company, we issue it to the billing details given in the order.
6. Delivery
- We deliver the activities electronically only, by making a download link available. The link appears right after the payment is confirmed, and we also send it to the email address given in the order.
- The activities are delivered at the moment the download link is made available to you.
- The link is valid for 30 days and each file can be downloaded through it at most 5 times. Please save the downloaded files. If you need a new link (for example after changing computers), write to us and we will send one free of charge.
- If the email with the link does not arrive within a few minutes of payment, check your spam or promotions folder and write to us.
- Each activity shows the languages in which it is available. Activities that require reading are sold only in the shop versions in whose language they exist.
7. Licence
By buying an activity you do not acquire the copyright, but a licence, that is the right to use the activity. The licence arises on payment of the price. It is the same for every buyer and covers the whole preschool, whether you buy in your own name or for a school or company. Its scope is set out in the licence terms, which form part of the contract.
8. Withdrawal from the contract
- A consumer has the right to withdraw from a distance contract without giving any reason within 14 days of its conclusion.
- For the activities, this right ends as soon as the download link is made available to you. The activities are digital content not supplied on a tangible medium. At checkout you expressly consent to the supply of digital content starting before the end of the withdrawal period and declare that you have been duly informed that by giving this consent you lose your right of withdrawal. We confirm this consent and declaration in the email confirming the contract. You then lose the right of withdrawal when the supply begins, that is when the download link is made available (Section 19(1)(m) of Slovak Act No. 108/2024 Coll. on consumer protection).
- We make the activities available right after payment, so an order cannot be sent without this consent.
- If you nevertheless have the right of withdrawal (for example, if you did not receive the confirmation under point 2), you can exercise it by a clear statement online using the Withdraw from the contract here function, by email to objednavky@edulo.eu or by letter to the seller's address in section 1. You may use the model withdrawal form, but you do not have to. The deadline is met if you send the notice no later than on the last day of the period. We will confirm receipt of a notice sent through the website by email without undue delay, together with its content and the date and time it was sent.
- After withdrawal we will refund all payments received no later than 14 days after we receive the notice of withdrawal, using the same means of payment you used and without any fees. After withdrawal, stop using the activities, do not make them available to others and delete the downloaded files. We may block the download link.
- A buyer who is not a consumer (for example a preschool, founding body or company) has no statutory right to withdraw from the contract without giving a reason.
- This does not affect a consumer's right to withdraw from the contract because of a defect under section 9.
- Full information on withdrawal and the model form are on the Withdrawal from the contract page.
9. Liability for defects and complaints
- The seller is liable to a consumer for any defect that an activity has at the time of supply and that becomes apparent within two years of supply. A defect means, in particular, that the activity does not work as described or does not work in an environment that meets the technical requirements in section 3.
- If a defect becomes apparent within one year of supply, it is presumed to have existed at the time of supply unless the seller proves otherwise. The seller is not liable for a defect if it proves that the buyer's computer, operating system or browser does not meet the technical requirements in section 3.
- Cooperation: the buyer must cooperate with the seller to a reasonable extent to establish whether the cause of the defect lies in the buyer's digital environment, for example by stating the operating system and browser, describing what happens or sending a screenshot. If the buyer does not cooperate, they must prove that the activity was defective at the time of supply in order to exercise their rights.
- A consumer has the right to have the defect remedied free of charge, for example by receiving a corrected file, within a reasonable time and at the latest within 30 days of reporting the defect. If the defect cannot be remedied or doing so would be disproportionately costly, if the seller does not remedy it in time, if the defect recurs or is serious, the consumer is entitled to a proportionate price reduction or may withdraw from the contract. A consumer may not withdraw because of a minor defect. We pay a price reduction or refund within 14 days using the same means of payment the buyer used.
- The procedure, confirmation and deadlines for complaints are set out in the complaints procedure.
- We handle complaints from buyers who are not consumers in the same way. Their rights for defects are, however, governed by the general rules of law.
10. Personal data
We process personal data only to the extent needed to handle the order and to meet our legal obligations. Details are in the privacy information. The activities themselves collect no data about children or teachers.
11. Dispute resolution
- If you are not satisfied with how we handled a complaint or believe that we have violated your rights, send us a request for redress by email to objednavky@edulo.eu.
- If we reject your request or do not reply within 30 days of sending it, you as a consumer have the right to submit a proposal for alternative dispute resolution to an ADR entity under Slovak Act No. 391/2015 Coll.
- The competent entity is the Slovak Trade Inspection (Slovenská obchodná inšpekcia), central inspectorate, Department of International Relations and Alternative Consumer Dispute Resolution, Bajkalská 21/A, P. O. BOX 29, 827 99 Bratislava 27, Slovakia, email ars@soi.sk or adr@soi.sk, www.soi.sk. You may also turn to another competent entity from the list of ADR entities kept by the Ministry of Economy of the Slovak Republic.
- Submit the proposal no later than one year after receiving our rejection or after the 30-day period has passed. The entity may refuse a later proposal. ADR before the Slovak Trade Inspection is free of charge. Your right to go to court is not affected.
- In a cross-border dispute within the EU, the European Consumer Centre in Slovakia or in your own country can also help you.
12. Final provisions
- The contract is governed by the terms and conditions as published on the day the order is sent. We send them as an attachment to the email confirming the contract, and you can save or print them at any time.
- The contract is governed by the law of the Slovak Republic, in particular the Slovak Civil Code and Act No. 108/2024 Coll. on consumer protection. If a consumer is habitually resident in another country, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the law of that country.
- The seller does not subscribe to any code of conduct.
- The seller may change these terms and conditions. Changes do not apply to contracts concluded before they take effect.
- These terms and conditions take effect on 29 October 2026.
